Madras HC to hear Vijay’s appeal against judge’s Reel Hero remark in Rolls-Royce Ghost case – India Today

The Madras High Court Division Bench will hear Thalapathy Vijay’s appeal regarding the order passed by single judge, Justice SM Subramaniam, dismissing his plea seeking exemption on entry tax collection for his 2012 Rolls-Royce Ghost. Vijay was fined Rs 1 lakh and was asked to deposit the money to the Tamil Nadu Chief Minister’s Covid-19 Relief Fund. Vijay’s legal team will also now approach the court against the verdict to highlight the judge’s remark made in the judgement.

MADRAS HC TO HEAR VIJAY’S APPEAL IN ROLLS-ROYCE GHOST CASE

On July 13, Vijay was fined Rs 1 lakh by the Madras High Court over his petition seeking exemption of tax on his imported car, the Rolls-Royce Ghost. Now, the Madras High Court Division Bench will hear the Bigil actor’s appeal regarding the order passed by the judge, SM Subramaniam.

Vijay’s dispense with application was listed before Justice MM Sundresh and RN Manjula of the Third Division Bench. However, Vijay’s writ appeal will be numbered and listed for hearing only after the bench dispenses with the production of the certified copy. This is due to the rules stating that an appeal filed before a Division Bench must be accomplished by a certified copy of the order passed by the judge. In case no certified copy is available, the appellant must prefer a dispense with the application and obtain the permission of the court to file the appeal based on an available web copy.

Vijay’s legal team had earlier mentioned that they would approach the court against the verdict especially to highlight the remarks made in the judgement that read that in Tamil cinema, heroes have become rulers, prompting people to believe them as real heroes. The judge also criticised Vijay’s actions, claiming the Reel Heroes take on corruption in cinema but act differently in real life. He also said that paying tax is mandatory and not an obligation or donation.

MADRAS HC JUDGES REFER VIJAY’S PLEA TO TAX BENCH

Judges MM Sundresh and C Saravanan refer Vijay’s plea to dispense with production of a certified copy of the order passed by Justice SM Subramaniam to the tax bench claiming that it was wrongly listed before them. They denied Vijay’s counsel’s request to list it for Tuesday claiming that Registry shall list it appropriately.
