Madras HC reprieve for DMK MP Kathir Anand, income tax action stayed – Times of India

CHENNAI: In a reprieve to DMK MP Kathir Anand, the Madras high court has restrained income tax department from initiating tax recovery proceedings against him by treating 11.48 crore found during a raid ahead of 2019 Lok Sabha election, as his income.
Justice C Saravanan passed the interim order on a plea moved by Kathi challenging the proceedings of the department. The court then directed the department to file its response to Kathir Anand’s petition and adjourned the hearing to January 3.
The petitioner’s primary contention was that the cash was seized from places not connected to him and persons not associated with him.
While the issue regarding the same is pending before the income tax settlement commission, the authorities have issued a show-cause notice seeking to explain why the money should not be treated as his income, the petitioner said.
Opposing the plea, the department submitted that the proceedings had been initiated only based on the materials and records seized during the raid.
